On the 8 October 2021, East Suffolk Council, Suffolk County Council and NNB Generation Company (SZC) Limited entered into a Deed of Obligation (DoO) pursuant to section 1 of the Localism Act 2011 and section 111 of the Local government Act 1972. The DoO related to all aspects of the Sizewell C project, however since the signing of the DoO, two Deed of Variations have been signed (13 April 2022 and 6 May 2022) which amend specific aspects of the original Deed.

The Sizewell C DOO adopted a novel approach. It is not a section 106 agreement; this would have been difficult to arrange as SZC Co. owned very little land within the Order Limits. An alternative model was allowed for the DoO agreed, this resulted in the entity who had the benefit of the dDCO (i.e. the “undertaker”) also being the entity bound by the planning obligations and not necessarily the landowner(s) within the Order Limits.
Clause 12.1.1 of the Deed of Obligation requires Sizewell C Limited to notify East Suffolk Council of the anticipated date of the commencement of works pursuant to the Sizewell C Development Consent Order at least 30 working dates prior to the actual date of commencement.
Clause 12.1.3 of the Deed of Obligation requires Sizewell C Limited to notify East Suffolk Council of the actual date of the commencement of works within 10 working days of the actual Commencement Date.
East Suffolk Council received notice from Sizewell C Limited of its intention to commence development under the Sizewell C Development Consent Order. East Suffolk Council confirmed that Sizewell C Limited had complied with the obligations within the Development Consent Order, Deed of Obligation and Charity Deed in relation to First Commencement.
