Deed of Obligation

On the 8 October 2021, East Suffolk Council, Suffolk County Council and NNB Generation Company (SZC) Limited entered into a Deed of Obligation (DoO) pursuant to section 1 of the Localism Act 2011 and section 111 of the Local government Act 1972. The DoO related to all aspects of the Sizewell C project, however since the signing of the DoO, two Deed of Variations have been signed (13 April 2022 and 6 May 2022) which amend specific aspects of the original Deed.

Details of the DoO and Deeds of Variation:

  • Deed of Obligation - Part 1 of 6
  • Deed of Obligation - Part 2 of 6
  • Deed of Obligation - Part 3 of 6
  • Deed of Obligation - Part 4 of 6
  • Deed of Obligation - Part 5 of 6
  • Deed of Obligation - Part 6 of 6
  • Deed of Obligation Annexures - Part 1 of 3
  • Deed of Obligation Annexures - Part 2 of 3
  • Deed of Obligation Annexures - Part 3 of 3
  • Deed of Variation - 13 April 2022
  • Second Deed of Variation - 6 May 2022

Further details on DOO Governance Groups (i.e. Community Groups, Working Groups, Review Groups).

The Sizewell C DOO adopted a novel approach. It is not a section 106 agreement; this would have been difficult to arrange as SZC Co. owned very little land within the Order Limits. An alternative model was allowed for the DoO agreed, this resulted in the entity who had the benefit of the dDCO (i.e. the “undertaker”) also being the entity bound by the planning obligations and not necessarily the landowner(s) within the Order Limits.
